End User Licence Agreement
Applies to Chuck and Chuck jnr (each "the Software"). Licensor: [Your business name] (ABN [ABN]) ("we", "us"). Contact: [support@your-domain].
1. Agreement
By installing, activating or using the Software you agree to these terms. If you accept them for a school or organisation, you confirm you're authorised to do so.
2. Licence
On payment of the applicable fee we grant you a non-exclusive, non-transferable licence to use the Software for your own educational purposes:
- Single-teacher licence — use by the one named teacher, on devices they use for their teaching.
- School / site licence — use by teaching staff of the one named school or campus.
The free trial may be used without payment, with some features unavailable. Each product (Chuck, Chuck jnr) is licensed separately.
3. Price and term
Licences are a one-off purchase covering the major version bought (for example all 4.x versions), including its updates. Future major versions may require a further fee. Prices are shown at checkout, including GST where applicable.
4. Refunds
You may request a full refund within 30 days of purchase by emailing [support@your-domain]. A refunded licence is cancelled and may stop working in later updates. Nothing in these terms limits your rights under the Australian Consumer Law.
5. Restrictions
You must not copy, share, resell or sublicense the Software or your licence beyond what you purchased; reverse-engineer it except where the law allows; remove notices; or circumvent its licensing.
6. Ownership
The Software is licensed, not sold. We retain all intellectual-property rights in it.
7. Your content
Information you enter ("your content") is yours. It is stored on your own device and is not transmitted to us. You are responsible for your content, for keeping backups, and for handling any personal information it contains in line with your school's policies and the law. Curriculum or syllabus material from third parties is not licensed to you by us.
8. Updates and availability
When installed from our website, the Software may download updates automatically. We aim to keep the website and Software available but don't guarantee uninterrupted availability. Your data remains on your device regardless.
9. Warranties and liability
Subject to the Australian Consumer Law, the Software is provided "as is", and to the extent permitted by law our liability is limited to re-supplying the Software or refunding the price paid. We are not liable for loss of data — please keep backups.
10. Ending this licence
This licence ends if you breach these terms. You may stop using the Software at any time; your data stays on your device and can be exported first.
11. General
These terms are governed by the laws of New South Wales, Australia. We may update these terms for future purchases; the terms at the time of your purchase apply to that licence.
